§ 1. The seller
The seller and organiser of the activities is Horseback Sp. z o.o., with its registered office at ul. Piastowska 1, 42-400 Zawiercie, Poland, entered in the register of entrepreneurs of the National Court Register under KRS 0000782843, tax identification number (NIP) 6492315792, statistical number (REGON) 383153942.
Activities take place at the Horseback Riding and Outdoor Activities Centre, Orle Gniazdo 20, 42-421 Hucisko, Poland. The registered office address is used for correspondence; Hucisko is the place of performance.

Horseback Sp. z o.o. is entered in the register of tour organisers and entrepreneurs facilitating the acquisition of linked travel arrangements, kept by the Marshal of the Silesian Voivodeship, under number 1984.
Horseback Sp. z o.o. benefits from the VAT exemption under Article 113 of the Polish VAT Act. Prices shown in the price list are final.
§ 2. Definitions
Client - a person purchasing a service: a consumer, a natural person entering into a contract directly related to their business activity but not of a professional character, or an entrepreneur or institution.
Consumer - a natural person making a purchase unrelated to their business or professional activity.
Participant - a person taking part in the activities, who may be someone other than the Client, in particular the Client's child.
Single session - a one-off riding session, hippotherapy session, pony ride for a child or another single service from the price list.
Pass - the right to use a specified number of sessions within the validity period stated in the price list.
Event - activities on a pre-determined date, without accommodation (for example a day at the stables, a picnic, a competition).
Package tour - an event including accommodation together with activities, in particular a weekend with an overnight stay or a riding camp.
Distance sale - a purchase made through horseback.pl or through a payment link sent to the Client, without the simultaneous presence of both parties.
On-site sale - a purchase made at the Centre in Hucisko, irrespective of the method of payment. Paying by QR code or link while at the Centre is an on-site sale.
Price list - the price list published at https://horseback.pl/cennik.
§ 3. Conclusion of the contract and payment
The contract is concluded upon payment and, for group and institutional sales, upon confirmation of the booking by Horseback.
In distance sales, payments are handled by Stripe Payments Europe, Ltd. Available payment methods are shown in the payment form. The price does not depend on the method chosen.
If the Client uses deferred payment or payment in instalments offered by the payment provider, that contract is concluded between the Client and that provider. This does not affect the price of the service or Horseback's obligations.
The button completing the order is labelled so as to indicate the obligation to pay. After using it, the Client is redirected to the payment provider's page.
Discount codes reduce the price. In the event of withdrawal or cancellation we refund the amount actually paid, not the list price.
Promotional prices and prices offered during events may carry conditions different from these terms, in particular a shorter pass validity. In such cases the conditions communicated to the Client at the time of sale prevail.
Prices are the same for on-site sales and distance sales.
§ 4. Passes
The number of sessions and the validity period follow from the price list. The validity period runs from the date of purchase.
At the Client's request made before the first session at the latest, the validity period may run from a date indicated by the Client, no later than one month from the date of purchase. Without such a request, validity runs from the date of purchase.
Sessions not used within the validity period expire. The value of unused sessions is not refunded or exchanged for another service, except as provided in paragraph 4 and in § 7 (withdrawal from the contract).
At the Client's request made within the validity period and supported by a medical certificate, the validity period is extended by the duration of the Participant's illness, by no more than 3 months.
The date of each session is arranged individually, subject to the availability of horses, instructors and weather conditions.
Sessions may be cancelled or moved no later than 48 hours before the agreed time. Cancellation after that point, as well as failure to attend, counts as one session used.
The pass is assigned to the Participant indicated at the time of purchase. A change of Participant requires Horseback's consent.
§ 5. Single sessions
When purchasing a single session, the Client either selects the date or arranges it with Horseback after the purchase, as stated for the given product.
§ 4 paragraph 6 applies (cancellation at least 48 hours in advance). Later cancellation or failure to attend counts as performance of the service and gives no right to a refund.
If a session cannot take place for reasons attributable to Horseback, in particular because of weather conditions endangering safety, illness of a horse or absence of an instructor, Horseback offers a new date and, if the Client does not accept it, refunds the full amount paid.
§ 6. Events on a specified date, without accommodation
Events take place on the day and at the times stated in the event description.
The number of places is limited. Registrations are accepted until the places are filled.
The Client's cancellation gives no right to a refund. The Client may, however, nominate another person to take their place, notifying Horseback no later than 24 hours before the start.
If the event does not take place for reasons attributable to Horseback, or is cancelled because weather conditions would endanger safety, the Client may choose a new date or receive a full refund.
Horseback may cancel the event if fewer than 5 participants register for it, notifying the Client no later than 3 days before the start of the event. The Client then receives a full refund within 14 days. No additional compensation is due.
Pursuant to Article 38(12) of the Polish Consumer Rights Act, the 14-day right of withdrawal does not apply to contracts for services connected with leisure, entertainment, sporting or cultural events where the contract specifies the day or period of performance. The Client is informed of this before the purchase.
§ 7. Right of withdrawal in distance sales
A consumer, and a natural person entering into a contract directly related to their business activity where the contract is not of a professional character, who has purchased a pass or a single session without a specified date by distance sale, may withdraw from the contract within 14 days of its conclusion, without giving a reason and without incurring costs, subject to paragraphs 4 and 5.
The right of withdrawal does not apply to on-site purchases (§ 2 paragraph 9), to events on a specified date (§ 6 paragraph 6) or to single sessions with a date specified at the time of purchase. Package tours are governed by § 8.
A withdrawal statement may be sent to [email protected] or by post to the registered office. The Client may use the model withdrawal form, which is an annex to these terms and is delivered together with the purchase confirmation. Sending the statement before the deadline is sufficient to meet it.
If the Client requested the commencement of performance before the withdrawal period expired and then withdrew, the Client pays for the performance rendered up to the moment of withdrawal. For a pass from which sessions have already been used, we refund the price less the value of the sessions used, calculated at the unit session price from the price list.
The right of withdrawal expires once the service has been performed in full, that is once the Participant has used all sessions from the pass, provided that the Client had requested the commencement of performance and had been informed of the loss of the right of withdrawal.
Refunds are made within 14 days of receipt of the withdrawal statement, using the same means of payment used by the Client, unless the Client expressly agrees otherwise. The Client bears no fees in connection with the refund.
§ 8. Package tours - events with accommodation and camps
Events comprising accommodation together with activities, and riding camps, are package tours within the meaning of the Polish Act of 24 November 2017 on package travel and linked travel arrangements. That Act applies to them instead of the rules on the right of withdrawal set out in § 7.
Before the contract is concluded, Horseback provides the Client with the standard information form and the terms of participation, stating in particular the programme, place, dates, total price, scope of services, insurance, minimum number of participants, cancellation rules and information on insolvency protection. Both documents are made available before payment and delivered with the purchase confirmation.
Horseback holds an insurance guarantee for tour organisers and pays contributions to the Tourist Guarantee Fund and the Tourist Assistance Fund. The guarantee details and the register entry number (1984) are stated in the standard information form. The beneficiary of the guarantee is the Marshal of the Silesian Voivodeship.
Withdrawal before the start of the package. The Client may withdraw at any time before the start of the package. Horseback then charges a fee corresponding to the costs incurred:
- withdrawal more than 30 days before the start - 10% of the price,
- withdrawal from 30 to 15 days before the start - 30% of the price,
- withdrawal from 14 to 7 days before the start - 50% of the price,
- withdrawal later than 7 days before the start - 90% of the price.
The fee corresponds to the costs Horseback incurs in preparing the package and cannot recover. At the Client's request, Horseback justifies the amount.
If unavoidable and extraordinary circumstances occur at or in the immediate vicinity of the place of the package, significantly affecting its performance or the carriage of participants, the Client may withdraw before the start without any fee and receives a full refund, without a right to additional compensation.
Transfer of the booking. The Client may transfer the rights and obligations under the contract to another person meeting the conditions of participation, notifying Horseback at least 7 days before the start. The Client and the transferee are jointly and severally liable for the price and for the actual, reasonable costs of the transfer, of which Horseback informs them.
Cancellation by Horseback. Horseback may cancel the package if the minimum number of participants stated in the information form is not reached, notifying the Client no later than 7 days before the start of a package lasting 2 to 6 days and no later than 20 days before the start of a package lasting more than 6 days. Horseback may also cancel the package due to unavoidable and extraordinary circumstances. In both cases the Client receives a full refund within 14 days, without additional compensation.
Changes to the price and conditions. The price may be increased only in the cases set out in the terms of participation and no later than 20 days before the start. An increase exceeding 8% of the price, and a change to essential terms of the contract, entitle the Client either to accept the change or to withdraw without a fee, within the period indicated by Horseback.
Complaints and assistance. The Client notifies Horseback of any lack of conformity during the package. Horseback remedies it or, where that is impossible, offers alternative arrangements. The Client is entitled to a price reduction for the period of non-conformity and to compensation under the Act. Horseback provides prompt assistance to participants in difficulty, in particular contact with medical services and with parents or guardians.
§ 9. Group and institutional bookings
Bookings for schools, kindergartens, companies, institutions and organised groups are made on the basis of an individual confirmation of the date and scope and, where needed, a separate contract. This paragraph applies to clients who are not consumers.
Horseback may make a booking conditional on a deposit of up to 20% of the agreed price. Article 394 of the Polish Civil Code applies to the deposit.
Cancellation by the Client gives no right to the return of the deposit. Horseback may additionally claim remuneration corresponding to the costs of preparing the activities where the cancellation occurred later than 3 days before the agreed date.
If the activities cannot take place because weather conditions would endanger safety, the parties agree a new date. The deposit remains valid for the new date.
§ 7 does not apply to bookings under this paragraph, except for contracts concluded by natural persons for whom the contract is not of a professional character.
§ 10. Minor participants, safety, declarations
A contract concerning the participation of a minor is concluded by their parent or legal guardian. A minor does not make the purchase.
The parent or legal guardian completes the participant card, including a declaration on the Participant's health and the absence of contraindications, and indicates the persons authorised to collect the child.
Health data of the Participant is processed solely on the basis of explicit consent, to the extent necessary for the safe conduct of the activities. Such data is not collected during the payment process.
The Participant follows the safety rules and the instructor's directions. The instructor may refuse admission or stop the activities if the Participant's condition or behaviour, or the prevailing conditions, endanger people or horses. The session is then treated as performed.
Horseback provides accident insurance for participants in holiday activities for children and young people (camps and day camps) where the Polish regulations on organised holidays require it. For all other activities and events accident insurance is not included in the price, unless the purchase confirmation states otherwise. Horseback recommends that participants hold their own accident insurance covering horse riding.
§ 11. Invoices
We issue an invoice at the Client's request submitted to [email protected], within the period provided by the applicable regulations. As Horseback is VAT-exempt, the invoice contains no VAT.
A Client purchasing on behalf of an entrepreneur or institution and paying through a payment processor provides the tax identification number (NIP) in the payment form, before completing the purchase. A NIP submitted after the purchase is included on the invoice only where the tax regulations allow it.
§ 12. Complaints
Complaints are accepted at [email protected] and at the registered office address. A complaint should state its subject matter and what the Client expects.
We reply to complaints within 14 days of receipt. Complaints concerning package tours are handled under § 8 paragraph 9.
Consumers may seek the assistance of the district or municipal consumer ombudsman and use out-of-court means of handling complaints and pursuing claims, in particular before the voivodeship inspector of the Trade Inspection. Information on these procedures is available from the Polish Office of Competition and Consumer Protection.
§ 13. Personal data
The controller of personal data is Horseback Sp. z o.o. The rules of processing, including information on the payment provider as a recipient of data, are set out in the privacy policy available at horseback.pl.
§ 14. Final provisions
Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on package travel and linked travel arrangements.
These terms do not limit consumer rights arising from mandatory provisions of law. A provision contrary to such a rule does not bind the consumer.
Horseback may amend these terms. Contracts concluded before an amendment are governed by the terms in force on the date of conclusion. Amendments are published on the website together with their effective date.
These terms are available in Polish and English. In the event of discrepancy, the Polish version prevails.
